Your legal requirements in Ecuador
What the law actually requires where you are — summarized from our jurisdiction guides. Open any topic for the full details.
Ecuador's Labour Code and Executive Decree 2393 require every workplace to have a first-aid kit and an emergency plan with trained brigades, keeping at least one trained worker per shift, plus an infirmary once 25 workers are on site simultaneously; no fixed numeric ratio applies beyond that.
Childcare follows the MIES Technical Norm for Child Development Centres (Ministerial Agreement 038 of 2023), requiring CDIs to respond to emergencies and provide first aid through a mandatory kit and trained brigades in their risk-reduction plan; it is an institutional-capability requirement with no fixed hours or per-staff certification, and online courses are accepted.
Ecuador's 2014 Comprehensive Organic Criminal Code (COIP) creates no general failure-to-rescue offence and no general bystander obligation, punishing only omission of relief during armed conflict (Art. 134) and failure to report by certain named professionals (Art. 276); otherwise liability arises only from a position of guarantor.
Ecuador has no mandatory nationwide continuing-education standard or state competency-certification process for health professionals, but medical and nursing staff are expected to hold a BLS certification renewable roughly every two years, driven by the employer or institutional accreditation; any recognized continuing-education activity on an eligible topic (CPR/AED, ACLS, PALS) meets it.
Residential and day gerontological centres are regulated by the MIES Technical Norm, and in formal institutions first-aid and CPR certification is mandatory for staff — the SETEC/MSP-endorsed nursing-assistant certification includes mandatory first-aid, CPR and geriatric-care modules; a recognized, up-to-date certificate renewed periodically meets it.
Foster families fall under the MIES Norma Técnica de Acogimiento Familiar, which requires applicants to pass social and psychological studies and complete a training program — including first aid, evacuation and fire prevention — before a MIES foster-family committee grants accreditation; current first-aid and CPR training is expected as part of the household's preparation.
Online CPR and first-aid training is recognized in Ecuador — Decree 2393 requires first-aid training without prescribing a format, so online courses are accepted (a grey zone) while recent emergency-plan rules keep brigade practice in person; certification is valid for 3 years.
